DMCA and Copyright Policy

TakumiHost respects intellectual property rights and expects all customers using our VPS hosting services to do the same. This policy explains how TakumiHost handles reports of copyright infringement and the process for submitting and responding to such reports.

This policy should be read alongside our Acceptable Use Policy and Terms of Service.


1. Copyright Infringement Reporting

If you believe that content hosted on TakumiHost infrastructure infringes your copyright, you may submit a written infringement notice to us. TakumiHost will review valid notices and take appropriate action, which may include removing or restricting access to the allegedly infringing material and notifying the customer responsible.

Please note that TakumiHost provides virtual server infrastructure to customers and does not routinely monitor or control the content hosted on individual VPS instances. We act on credible, properly submitted infringement notices.


2. Required Information for a Valid Infringement Notice

To be considered valid, your infringement notice must include all of the following:

  • Your full legal name and contact information, including a valid email address and mailing address
  • A description of the copyrighted work you claim has been infringed
  • A description of the material you believe is infringing, with sufficient detail to allow us to locate it (such as a URL, IP address, or other identifying information)
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Notices that do not include all required information may not be acted upon. Submitting a false or misleading infringement notice may expose you to legal liability.


3. Submitting an Infringement Notice

We will acknowledge receipt of your notice and investigate the claim. Response times may vary depending on the complexity of the report.


4. Action on Valid Notices

Upon receiving a valid and complete infringement notice, TakumiHost will:

  • Review the notice and assess its validity
  • Notify the customer associated with the reported content where appropriate
  • Take reasonable steps to remove or restrict access to the allegedly infringing material if the notice is found to be valid

TakumiHost acts in good faith when responding to infringement notices but does not make legal determinations of infringement. Our response to a notice does not constitute an admission that infringement has occurred.


5. Counter-Notification Process

If you are a TakumiHost customer and believe that material hosted on your VPS was removed or restricted as a result of a mistaken or misidentified infringement notice, you may submit a counter-notification.

A valid counter-notification must include:

  • Your full legal name and contact information
  • Identification of the material that was removed or restricted, and its location before removal
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or restricted as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the party who submitted the original notice
  • Your physical or electronic signature

6. Repeat Infringer Policy

TakumiHost maintains a policy of terminating the services of customers who are found to be repeat infringers of intellectual property rights. A customer may be considered a repeat infringer if they receive multiple valid infringement notices or if their VPS is repeatedly used to host infringing content.

Termination for repeat infringement is consistent with our Terms of Service and Cancellation and Service Termination Policy.


7. Limitation of Liability

TakumiHost is not liable for content hosted by customers on their VPS instances. Customers are solely responsible for ensuring that all content and activities on their VPS comply with applicable copyright laws and these policies.


8. Changes to This Policy

TakumiHost may update this DMCA and Copyright Policy at any time. Changes will be reflected by updating the date at the top of this page.
