Please read these Terms of Service carefully before purchasing or using any service offered by TakumiHost. By accessing our website at www.takumihost.shop or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and TakumiHost ("we," "us," or "our"). By creating an account, placing an order, or using any TakumiHost service, you accept these Terms in full. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

TakumiHost provides Virtual Private Server (VPS) hosting and related virtual server services. Our services are delivered digitally. Upon successful payment and order processing, you will receive an email containing your VPS service details, which may include:

  • VPS service summary and plan details
  • Server IP address
  • Login credentials or access information
  • Operating system information
  • Resource configuration details
  • Server access instructions and setup guidance
  • Service activation information
  • Any other information required to access and use your VPS

TakumiHost does not ship physical goods. All services are provisioned and delivered electronically.

3. Eligibility and Account Responsibility

To use our services, you must be at least 18 years of age and capable of entering into a legally binding agreement. By placing an order, you confirm that all information you provide is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of any credentials or access information provided to you. You agree to notify us immediately at aonnon12343@outlook.com if you suspect any unauthorized access to your account or VPS.

4. Customer Information and Order Accuracy

You are responsible for providing accurate contact and payment information when placing an order. TakumiHost relies on the email address you provide to deliver your VPS service details. We are not responsible for non-delivery caused by an incorrect or inaccessible email address.

If you do not receive your service delivery email within the expected timeframe, please check your spam or junk folder before contacting support.

5. VPS Provisioning and Service Activation

After your payment is confirmed, we will begin provisioning your VPS. Provisioning is typically completed promptly, though processing times may vary depending on the plan selected, server availability, and order verification requirements.

Once provisioning is complete, your VPS service details will be sent to the email address associated with your order. It is your responsibility to follow the provided instructions to access and configure your server.

6. Service Availability

TakumiHost makes reasonable efforts to maintain service uptime and reliability. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance, infrastructure upgrades, or circumstances beyond our control may result in temporary service interruptions.

We will make reasonable efforts to notify customers of planned maintenance in advance where possible.

7. Customer Responsibilities

As a customer, you are responsible for:

  • All activity that occurs on your VPS, including any software you install or run
  • Keeping your server software, operating system, and applications up to date and secure
  • Ensuring your use of the VPS complies with all applicable laws and regulations
  • Maintaining appropriate backups of your data
  • Complying with these Terms and our Acceptable Use Policy

TakumiHost provides the virtual server environment. We are not responsible for the content, applications, or activities hosted on your VPS.

8. Acceptable Use

You agree to use TakumiHost services only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of our services. You must comply with all applicable local, national, and international laws and regulations.

9. Prohibited Activities

The following activities are strictly prohibited on TakumiHost infrastructure:

  • Hosting, distributing, or transmitting illegal content of any kind
  • Sending unsolicited bulk email (spam) or operating spam-related services
  • Conducting or facilitating distributed denial-of-service (DDoS) attacks or any form of network abuse
  • Port scanning, vulnerability scanning, or unauthorized probing of third-party systems
  • Mining cryptocurrency without prior written approval
  • Operating phishing sites, malware distribution networks, or fraudulent services
  • Hosting content that exploits or harms minors in any way
  • Reselling TakumiHost services without authorization
  • Any activity that places excessive or unreasonable load on our infrastructure
  • Attempting to gain unauthorized access to TakumiHost systems or other customers' servers

Violation of this section may result in immediate service suspension or termination without refund.

10. Payments and Billing

All prices are listed in US Dollars (USD) unless otherwise stated. Payment is required in full at the time of purchase. We accept payment through the methods available at checkout, which may include PayPal and other supported payment processors.

By completing a purchase, you authorize TakumiHost to charge the full amount for the selected service plan. All sales are subject to the terms of our Refund and Cancellation Policy.

11. Service Renewal

VPS hosting plans are offered on a subscription or term basis as indicated at the time of purchase. If your plan includes automatic renewal, you will be notified in advance. It is your responsibility to manage your subscription and cancel before the renewal date if you do not wish to continue.

TakumiHost is not responsible for charges resulting from failure to cancel a subscription before renewal.

12. Suspension and Termination

TakumiHost reserves the right to suspend or terminate your service at any time, with or without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is associated with fraudulent, abusive, or illegal activity
  • Payment is not received or a chargeback is initiated
  • Continued operation of your VPS poses a risk to our infrastructure or other customers

In cases of serious violations, termination may be immediate and without refund. For non-violation-related terminations initiated by TakumiHost, we will make reasonable efforts to provide advance notice.

13. Intellectual Property

All content on the TakumiHost website, including text, graphics, logos, and software, is the property of TakumiHost and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

You retain ownership of any content or data you store on your VPS. By using our services, you grant TakumiHost no rights to your data beyond what is necessary to provide the service.

14. Third-Party Services

TakumiHost may integrate with or recommend third-party tools, control panels, or services (such as CloudPanel, CyberPanel, or Hestia). These third-party services are governed by their own terms and privacy policies. TakumiHost is not responsible for the availability, accuracy, or conduct of any third-party service.

15. Disclaimer of Warranties

TakumiHost services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components.

16. Limitation of Liability

To the maximum extent permitted by applicable law, TakumiHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services — including but not limited to loss of data, loss of revenue, or business interruption.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to TakumiHost in the 30 days preceding the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless TakumiHost and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any third-party rights.

18. Changes to Services and Terms

TakumiHost reserves the right to modify these Terms or our services at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TakumiHost operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation where possible.
